MIDWIFEPLUS
CLIENT TERMS & CONDITIONS
1. Definitions
Client means any individual using the Platform to locate or contact a midwife.
Contractor means an independent midwife listed on the Platform who provides Services directly to Clients.
Platform means the MidwifePlus website, applications, and related digital services.
Services means maternity, antenatal, postnatal, or neonatal care provided directly by a Contractor.
Company, MidwifePlus, we, us, or our means MidwifePlus Ltd.
2. Platform Role
2.1 MidwifePlus operates solely as a digital marketplace platform that enables Clients to locate and contact independent midwives.
2.2 MidwifePlus does not provide healthcare, medical treatment, or clinical services.
2.3 Any agreement for Services is formed directly between the Client and the Contractor.
2.4 MidwifePlus is not a party to any contract for Services and has no control over the provision of those Services.
2.5 MidwifePlus does not supervise, manage, or direct Contractors in their clinical work.
3. Independent Midwives
3.1 All Contractors operate as independent healthcare professionals and are not employees, agents, or representatives of MidwifePlus.
3.2 Contractors are solely responsible for:
- their clinical decisions
- professional judgement
- regulatory compliance
- maintaining valid professional registration
- holding appropriate professional indemnity insurance
- maintaining professional standards
- delivery of Services to Clients
3.3 MidwifePlus does not provide clinical oversight, supervision, or medical governance of Contractors.
4. Contractor Information and Verification
4.1 MidwifePlus may verify certain information provided by Contractors, including professional registration with the Nursing and Midwifery Council.
4.2 Such verification is limited and does not constitute a clinical competence assessment, background check, or endorsement.
4.3 MidwifePlus does not guarantee the suitability, competence, availability, or quality of any Contractor.
4.4 Clients are responsible for making their own independent decision when selecting a Contractor.
5. Payments
5.1 Payments for Services are made directly between the Client and the Contractor.
5.2 MidwifePlus does not collect, hold, or process payments for Services.
5.3 Contractors are solely responsible for:
- setting their fees
- issuing invoices
- managing refunds
- handling payment disputes
5.4 MidwifePlus is not responsible for payment disputes between Clients and Contractors.
6. Cancellations and Refunds
6.1 Cancellation and refund policies are determined by the Contractor.
6.2 Clients should refer to their agreement with the Contractor for applicable cancellation terms.
6.3 Nothing in these Terms affects a Client’s statutory rights under UK consumer protection law, including the Consumer Rights Act 2015.
7. Medical Disclaimer
7.1 Information provided on the Platform is for general informational purposes only.
7.2 Content on the Platform does not constitute medical advice, diagnosis, or treatment.
7.3 Clients should always seek advice from a qualified healthcare professional regarding medical concerns.
8. Emergency and Safeguarding
8.1 MidwifePlus does not provide emergency medical services.
8.2 If you believe you or your baby require urgent medical attention, you must immediately contact the National Health Service, dial 999, or attend the nearest hospital.
8.3 MidwifePlus does not monitor pregnancies, health conditions, or clinical outcomes.
8.4 Contractors are responsible for determining when escalation to NHS or hospital services is required.
9. Liability
9.1 MidwifePlus is not responsible for:
- clinical decisions made by Contractors
- medical advice or treatment provided by Contractors
- service quality or outcomes
- appointment cancellations or delays
- disputes between Clients and Contractors
9.2 To the fullest extent permitted by law, MidwifePlus excludes liability for any indirect or consequential loss arising from use of the Platform.
9.3 Nothing in these Terms excludes or limits liability for:
- death or personal injury caused by negligence
- fraud or fraudulent misrepresentation
- any liability that cannot legally be excluded under the laws of England and Wales
10. Platform Use
Users must not:
- create false or fraudulent accounts
- impersonate another person
- scrape, extract, or harvest data from the Platform
- harass, threaten, or abuse other users
- use the Platform for unlawful purposes
MidwifePlus reserves the right to suspend or terminate access where misuse is suspected.
11. Platform Availability
11.1 MidwifePlus aims to maintain continuous access to the Platform but does not guarantee uninterrupted availability.
11.2 The Platform may be temporarily unavailable due to maintenance, updates, or technical issues.
12. Data Protection
12.1 MidwifePlus processes personal data in accordance with:
- UK GDPR
- Data Protection Act 2018
12.2 Further details are provided in the MidwifePlus Privacy Policy.
12.3 Contractors act as independent data controllers for any clinical records they create or maintain.
13. Intellectual Property
All intellectual property rights in the Platform, including branding, content, and design, belong to MidwifePlus or its licensors.
Users may not reproduce, distribute, or commercially exploit Platform content without written permission.
14. Changes to Terms
MidwifePlus may update these Terms from time to time.
Updated Terms will be published on the Platform and take effect upon publication.
15. Governing Law
These Terms are governed by the laws of England and Wales.
Any disputes arising in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
